“Funcionarios del gabinete de Peñalosa habrían construido ilegalmente en la reserva Thomas van der Hammen”, dice Ángela Robledo
Bogotá, abril 6 de 2016
La representante a la Cámara y Copresidenta de la Comisión de Paz del Congreso Ángela Robledo aseguró hoy en debate de control político que funcionarios que acompañan la administración de Enrique Peñalosa estarían atentando contra la moralidad administrativa contemplada en la Sentencia de la Corte Constitucional C-046 de 1994 y deberían declarar públicamente su conflicto de intereses. Ver denuncia
La congresista presentó el caso de Andrés Ortiz quien en su declaratoria de impedimentos aseguró que “(…) la parcelación Las Lomitas inició el trámite de legalización el 27 de septiembre de 2002 ante la Dirección de Legalización de Barrios de esta entidad [Secretaría Distrital de Planeación]”, es decir, que el Secretario de Planeación, experto constructor, edificó su predio sin licencia y desconociendo la Ley de Ordenamiento Territorial. De acuerdo con la congresista Ángela Robledo las leyes de ordenamiento territorial (Ley 9 de 1989 y Ley 388 de 1997) obligan a los constructores a tramitar y obtener licencias: «(…) Para adelantar obras de construcción, ampliación, modificación y demolición de edificaciones, de urbanización y parcelación en terrenos urbanos, de expansión urbana y rurales (…) expedidas por los municipios, los distritos especiales, el Distrito Capital (…) ”
Esta norma además establece que “(…) se requerirá licencia para el loteo o subdivisión de predios para urbanizaciones o parcelaciones en toda clase de suelo, así como para la ocupación del espacio público con cualquier clase de amoblamiento”.
En similares irregularidades estarían incurriendo la Gerente de la Empresa de Energía de Bogotá, Astrid Álvarez, quien públicamente aceptó que posee una casa en la Reserva; el Secretario Distrital de Ambiente, Francisco Cruz y el Asesor del Distrito para el Proyecto Ciudad Norte, Camilo Santamaría. “¿Con qué autoridad moral gobiernan los funcionarios de la Alcaldía de Bogotá que le hacen conejo a las normas para sacar provechos personales?”, dijo.
Ángela Robledo aseguró que es un deber ético de Peñalosa y su gabinete preservar la reserva forestal Van der Hammer que permita la sostenibilidad ambiental hoy y en el futuro de Bogotá, tal como lo recomendó la Municipalidad de Barcelona (ciudad que cuenta con un reserva natural similar) en una carta dirigida al Alcalde Peñalosa. Ver carta.
“No tiene ninguna presentación ni ética, ni política que Enrique Peñalosa priorice la construcción sobre el bosque urbano más grande de América Latina y que atente contra el ecosistema hídrico y natural con que cuentan los 1.395 hectáreas que allí subsisten”, aseguró la congresista Ángela Robledo.
La parlamentaria afirmó que no puede ser más importante la urbanización y el crecimiento de la ciudad sobre los bosques y el ecosistema que allí perdura, en un mundo amenazado por el cambio climático, la escasez de agua y la sequía. “No creo que sea tan difícil entender que podemos hacer muchísimas casas y edificios pero si no tenemos aire y agua, la vida no perdurará ni hoy, ni dentro de 50 años que es la preocupación de Enrique Peñalosa de adelantar el proyecto Ciudad Norte”, dijo.
La reserva Van der Hammen aporta a la adaptación y mitigación frente al cambio climático dándole a Bogotá un espacio verde que ayuda a contrarrestar sus emisiones, ser más resiliente y reducir la vulnerabilidad y los riesgos relacionados con la variabilidad climática. “ La tal reserva -como la llama Peñalosa- es una realidad jurídica avalada por más de 50 estudios académicos que no puede desaparecer para superar el déficit de vivienda en el año 2050 que el Alcalde imagina que necesitaremos”, señaló la congresista.
Ángela Robledo aseguró que si de lo que se trata es de construir viviendas en esa zona, podrían hacerlo en las 2.014 hectáreas del borde norte de la ciudad, en donde se calcula, de acuerdo al Plan de Ordenamiento Zonal, se pueden construir 180 mil viviendas con todo el soporte urbano requerido sin afectar la Reserva.
“Ahora si lo que quieren es cambiar el uso del suelo de rural a urbano para multiplicar su valor que no nos echen cuentos peregrinos. Que nos digan cuál es el negocio que tiene Peñalosa y algunos de sus funcionarios para quienes todo vale, sobre todo si hay cemento de por medio. Recordemos que más del 50% de la campaña de Enrique Peñalosa a la Alcaldía de Bogotá (1.107.500.000 millones) lo aportaron los constructores.
La congresista llamó la atención sobre la participación de Sandra Rozo (Directora de Bienes Raíces del Acueducto) quien suspendió la compra de predios dirigida a preservar la Reserva. “Sandra Rozo es la cuñada del exgobernador de Cundinamarca, Álvaro Cruz, procesado por corrupción y con quien Enrique Peñalosa ha tenido estrechos vínculos”, dijo Ángela Robledo.
La congresista puntualizó que tal como señala la Corte Constitucional, la moralidad administrativa no se circunscribe al fuero interno de los servidores públicos, sino que abarca toda la gama de comportamientos que la sociedad, en un momento dado, espera de quienes manejan los recursos de la comunidad, que no puede ser otro que el de absoluta pulcritud y honestidad.
