Denuncian total impunidad frente a homicidios de estudiantes atribuibles al ESMAD

Miguel Ángel Barbosa, 18 años, estudiante de Mecánica; Edison Franco Jaime; Yoel Jácome Ortiz, Hermides Jaime Téllez; Diomar Alfonso Quintero; Nicolás Valencia Lemus; Celestino Rivera; César Hurtado Tróchez; Oscar Salas, 20 años, estudiante de Lingüística; Jhonny Silva, 21 años, estudiante de Química; Nicolás David Neira, 15 años; Jaime Alfonso Acosta; Carlos Giovanni Blanco, estudiante de Medicina, entre muchos otros jóvenes, fueron asesinados por disparos de bala, de gases lacrimógenos y golpes, en distintas protestas universitarias en las que se vieron enfrentados con el Escuadrón Móvil Antidisturbios (ESMAD) de la policía; casos que han sido suficientemente documentados pero que hasta el momento se encuentran en la total impunidad, pese a que, en algunos de estos casos, han transcurrido 10 años o más.
Así, lo denunció hoy Ángela María Robledo quien junto con los representantes a la Cámara Alirio Uribe, Víctor Correa, German Navas, Inti Asprilla y Oscar Ospina, adelantaron una Sesión de Comisión Accidental de Seguimiento a los directores de la Policía Nacional, del ESMAD y de Medicina Legal, frente a la muerte de varias personas, en la que estaría presuntamente comprometidos miembros del ESMAD.
Ángela María Robledo dijo que pese a los principios que deben guiar la actuación del ESMAD y que incluye “respetar y proteger la vida humana”, mediante “el uso racional de la fuerza”, distintas fuentes evidencian lo contrario. Incluso se han conocido declaraciones en las que los propios miembros del ESMAD implicados en estos hechos de fuerza desmedida, así lo reconocen. Por ejemplo, en el Caso de Oscar Salas de 20 años, estudiante de lingüística de la Universidad Distrital, asesinado en 2006, en una protesta en la Universidad Nacional, la Procuraduría tiene testimonios y evidencias que así lo indican. El caso sigue en la impunidad.
Otros caso como el de Jhonny Silva, de 21 años, estudiante de Química de la Universidad del Valle, asesinado por un disparo de bala en su universidad, en el que según la Fiscalía en 2008 estaba involucrado un miembro del ESMAD pero que dio un giro inesperado en 2010 cuando un fiscal delegado ante el Tribunal Superior de Cali revocó la acusación. La familia de Silva emprendió una batalla jurídica en contra del Estado colombiano y llevó el Caso ante la Comisión Interamericana de Derechos Humanos que aún no ha fallado. El caso sigue en la impunidad.
Recientemente se conoció el caso de Miguel Ángel Barbosa de 18 años, estudiante de Mecánica de la Universidad Distrital, quien falleció luego de que un artefacto disparado al parecer por el ESMAD le impactara en la cabeza. El caso está en manos de la Fiscalía y aun no se conoce su desenlace. El caso está en la impunidad.
De acuerdo con el Ministerio de Defensa, el ESMAD está integrado por más de 3.000 hombres y mujeres que cuenta con una partida presupuestal de 327 mil millones de pesos. Según el banco de datos del CINEP, presentados por el representante Alirio Uribe, entre 2002 y 2014 se registraron 448 casos de agresiones que dejaron alrededor de 3950 víctimas a nivel nacional en las que presuntamente participó el ESMAD, discriminadas, entre otras, en 137 personas heridas, 91 casos de detenciones arbitrarias, 107 casos de amenazas individuales y colectivas, 13 casos de ejecuciones extrajudiciales, 2 casos de violencia sexual.
De acuerdo con Ángela María Robledo, “estos casos de estudiantes y este despliegue de fuerza y violencia deja muchas preguntas sobre el ESMAD y su rol en la disolución de manifestaciones y en el papel que asumirá en el posconflicto, teniendo en cuenta que de acuerdo a las normas internacionales y a la jurisprudencia nacional, se ha reiterado que en un Estado Social de Derecho como el colombiano, la Policía no solamente está instituida para preservar el orden público sino que su principal función consiste en garantizar el respeto por la dignidad humana y la protección de los derechos humanos”.
Los congresistas anunciaron que llevarán estos y otros casos ante el Sistema Interamericano de Derechos Humanos por considerar que las muertes de estos jóvenes en protestas sociales y estudiantiles son consideradas, en el derecho internacional, como ejecuciones extrajudiciales.
