Aprobado en primer debate proyecto de ley de prima para trabajadoras domésticas

Ángela María Robledo, representante a la Cámara y co autora del Proyecto de Ley No. 003 de 2015 Cámara, presentó ponencia positiva a la iniciativa por medio de la cual se garantiza el acceso en condiciones de universalidad al derecho prestacional de pago de prima de servicios para trabajadoras domésticas, que fue aprobada por la Comisión VII de la Cámara de Representantes.
Este proyecto está fundamentado, entre otros, en el Convenio 189 de la OIT, ratificado por Colombia y que apunta no sólo a la formalización del trabajo en igualdad de condiciones para todos los trabajadores, sino en la búsqueda de condiciones de trabajo decente.
De igual manera, la iniciativa de la Bancada Verde busca concretar el mandato de la Corte Constitucional en la Sentencia C-871 de 2014 que insta al Congreso y al mismo Gobierno para que se avance en el reconocimiento de condiciones dignas, justas y en igualdad de condiciones de las trabajadoras domésticas.
Cifras del Ministerio de Trabajo (2014), indican que en Colombia hay 709.000 personas dedicadas a trabajar como empleados domésticos, de los cuales 674.000 (95%) correspondían a mujeres y 36.000 (5%) hombres, que ganan menos de un salario mínimo. Según la Encuesta Integrada de Hogares del mismo año, la mayoría de los trabajadores domésticos el 44% está entre los 41 y 60 años. Se estima que apenas ocho mil cuentan con contrato de trabajo escrito, es decir, que la mayoría no cuenta con ninguna protección social.
Es de anotar que un buen porcentaje de estas mujeres provienen de los sectores más desfavorecidos del país, la mayoría han sido víctimas de desplazamiento forzado, violencia sociopolítica y sobrevivientes de violencia sexual.
Ángela Robledo señaló que la familia es el primer lugar donde arranca el cuidado de la vida que le aporta riqueza al país y que el trabajo de las mujeres es también un trabajo productivo y por tanto urge que se le reconozca como sujetos de derechos laborales.
De acuerdo con la investigadora Sandra Muñoz (2015) es necesario transformar el trabajo doméstico en uno laboralizado y desligado de la esfera de lo reproductivo y de lo privado y garantizar por lo menos cuatro elementos mínimos de trabajo decente que define la OIT: Empleo productivo, protección en seguridad social integral, trabajo con garantía a los derechos fundamentales y diálogo social.
