Representante Ángela María Robledo, solicitó a la CPI, que verifique la actuación de miembros de las fuerzas militares en casos de violencia sexual en Colombia
Bogotá, D.C., Noviembre 20 de 2020. La Representante a la Cámara Ángela María Robledo, en su calidad de integrante del grupo de Parlamentarios para la Acción Global[1] – PGA – solicitó hoy, al Fiscal Adjunto de la Corte Penal Internacional, James Steward y a la Asesora Especial en Género de la misma, Patricia Viseur Seller, durante el desarrollo de la 11ª Asamblea Consultiva de Parlamentarios sobre la Corte Penal Internacional y el Estado de Derecho[2], que hicieron presencia, para que continúe el seguimiento relacionado con violencia sexual y de género, sobre el cual están recopilando información, en el marco del examen preliminar para el caso de Colombia.
La solicitud la realizó, en virtud de la invitación que le cursó la señora Margareta Cederfelt, Presidenta del grupo Parlamentarios para la Acción Global, y el señor Boris Dittrich, Presidente del Grupo Nacional de GPA en los países bajos, a participar en la 11ª Asamblea Consultiva de Parlamentarios sobre la Corte Penal Internacional y el Estado de Derecho[3], como coautora de la Ley 1719 de 2014, para garantizar el derecho de acceso a la justicia de las víctimas en especial de la violencia sexual asociada al conflicto armado interno.
De igual manera, la Congresista, le pidió a la Corte Penal Internacional, extienda al Estado colombiano, una solicitud de información, con el fin de examinar en detalle la situación de crímenes cometidos por todos los actores del conflicto armado, especialmente por las fuerzas de seguridad del Estado, de tal manera que se pueda tener un análisis independiente e imparcial bajo el principio de complementariedad, relacionado con las problemáticas que se presentan en el acompañamiento, restablecimiento de derechos y acceso a la justicia de las víctimas de violencia sexual, muchas de las cuales se encuentran en situación de vulnerabilidad y hacen parte de poblaciones étnicas, por lo cual merecen especial protección.
Para la Parlamentaria, “Mi solicitud a la CPI está dirigida, no sólo para que Colombia siga siendo un país observado, sino para que ojalá puedan realizar una recomendación a los integrantes de las Fuerzas militares en Colombia, en virtud de su presunta responsabilidad en casos de violencia sexual, que tienen un alto grado de impunidad”
La Representante a la Cámara Ángela María Robledo, así mismo, remitió a la Corte Penal Internacional, adjunto a la solicitud, un breve informe actualizado que contiene algunas de las afectaciones sistemáticas que sufren las mujeres, jóvenes y niñas a partir de las distintas formas de violencia en Colombia. Parte del cual fue construido y presentado por ella, y por la Senadora Aida Avella a la Relatora Especial de las Naciones Unidas sobre la Violencia contra la Mujer Doctora Dubravka Šimonović con quien se realizó un dialogo constructivo junto a mujeres y lideresas de todas las regiones del país, en el marco de la coordinación de acciones para prevenir la violencia contra la mujer.
El informe hace énfasis en la violencia sexual y armada en el marco del conflicto, la violencia política que se evidencia en las agresiones contra defensoras de derechos humanos, junto con la exclusión y el silenciamiento de las mujeres de la oposición y la violencia social vinculada a la estigmatización y a las difíciles condiciones que enfrentan las mujeres para acceder a sus derechos, incluidos el acceso a la justicia y a la verdad.
La Asamblea Consultiva de Parlamentarios sobre la Corte Penal Internacional y el Estado de Derecho, contó con la presencia del Excelentísimo señor Juez Chile Eboe – Osuji, Presidente de la Corte Penal Internacional, del señor James Steward, Fiscal Adjunto, de la señora Patricia Viseur Sellers, Asesora Especial en Género de la Fiscalía de CPI, señor Fabio Massimo Castaldo, Vicepresidente del Parlamento Europeo, miembro del GPA, la Honorable Shandana Gulzar Khan, presidenta del Grupo de Parlamentarias de la Commonwealth, el señor Ali Ehsassi, miembro de la Junta Directiva de GPA, Presidente del Grupo Parlamentario de todos los partidos para la Prevención del Genocidio y otros Crímenes de Lesa Humanidad, entre otros y otras.
[1] Parlamentarios para la Acción Global (PGA, por sus siglas en inglés) es la red internacional, no gubernamental y multipartidista más grande de legisladores individuales que cuenta con aproximadamente 1,200 miembros en 138 parlamentos de todo el mundo. PGA moviliza a los parlamentarios como defensores comprometidos con la promoción del Estado de Derecho, la democracia, la seguridad humana, la inclusión y la igualdad de género
