Ángela María Robledo rechaza las mentiras de la Directora del ICBF
Bogotá, enero 27 de 2017
La representante a la Cámara y Co presidenta de la Comisión de Paz del Congreso, Ángela María Robledo, rechazó la decisión del Gobierno Nacional de objetar el Proyecto de Ley «Por medio del cual se establecen lineamientos para el trabajo desarrollado por las personas que prestan sus servicios en los programas de atención integral a la primera infancia y protección integral de la niñez y adolescencia del Instituto Colombiano de Bienestar Familiar (ICBF), sus derechos laborales, se establecen garantías en materia de seguridad alimentaria y se dictan otras disposiciones (…)” y que fue aprobado unanimamente por el Congreso de la República en diciembre pasado, así como las declaraciones entregadas por la Directora del ICBF, Cristina Plazas.
“No es verdad lo que asegura la Directora del ICBF, Cristina Plazas en el sentido de que las mujeres están vinculadas formalmente al Instituto y que gozan de todos los derechos laborales, en tanto que sus contratos dependen de terceros que era lo que la Corte Constitucional ordenó modificar vía la Sentencia T-480 de 2016 que reconoció y pidió al estado pagar a favor de las accionantes los salarios y prestaciones sociales causados, y dejados de percibir, en razón a la labor de madre comunitaria que realizaron al Programa Hogares Comunitarios de Bienestar del ICBF. El Gobierno desacata el llamado de la Corte Constitucional que les reconoce su condición de contrato realidad de trabajadoras con derechos plenos”, aseguró Robledo.
“Tampoco es cierto que exista un programa especial de vivienda para ellas. Por lo menos no lo conozco, así como un plan de formación y promoción académica. Los pocos avances que tienen los han logrado ellas en contravía del ICBF como derechos y no como beneficios tal como señala Plazas”, dijo la congresista.
“Objetar esta ley que reconoce el trabajo de 134 mil madres comunitarias –no de 60 mil como dice Plazas- es objetar el trabajo digno y la labor de cuidado de las mujeres que atienden unos 800.000 menores de edad en todo el país, asumiendo la responsabilidad del ICBF, que les ha delegado esta tarea”, aseguró la congresista Ángela María Robledo quien fue coordinadora ponente del proyecto.
La congresista insistió en que esta Ley estaba sustentada en los artículos 10, 13, 14, y 143 del Código Sustantivo del Trabajo que reconoce que a iguales obligaciones, iguales derechos, así como en las leyes 1023 de 2006, 1187 de 2008, 1607 de 2012, que han incluido de manera progresiva el reconocimiento del salario mínimo legal mensual a las madres comunitarias, sustitutas y tutoras, y su formalización laboral.
“El ICBF apoyó el trámite del proyecto en audiencias públicas, así como los debates en las distintas comisiones y plenarias del Congreso. De igual manera firmó compromisos con los sindicatos de madres comunitarias y ahora se lava las manos diciendo que no hay presupuesto. Lamento profundamente esta decisión del Gobierno que no reconoce los derechos de las mujeres en Colombia y prefiere seguir tercerizando el trabajo de las madres comunitarias que se ocupan del cuidado de los niños por asuntos fiscales”, puntualizó Ángela Robledo.
