¡Gustavo Petro tenía la razón¡
El pueblo es soberano
Bogotá, D.C., Agosto 19 de 2020. Frente a la sentencia emitida por la Corte Interamericana de Derechos Humanos que declaró al Estado Colombiano como responsable por la violación de los derechos políticos y las garantías judiciales, en virtud de la decisión de la Procuraduría General de la Nación en el 2013 de destituir e inhabilitar al hoy senador Gustavo Petro, su fórmula vicepresidencial en las pasadas elecciones Ángela María Robledo, y actual Representante a la Cámara por la Colombia Humana, cuestionó la continuidad de Alejandro Ordoñez como embajador ante la OEA, ya que fue el mismo exfuncionario en su condición de Procurador quien destituyó a Gustavo Petro e incurrió en la violación de los derechos y de los derechos de sus electores.
Para la Congresista, no hay duda que con la decisión de la Corte IDH “Gustavo Petro le ganó el pulso a Alejandro Ordoñez, hoy embajador de Colombia ante la OEA, organismo internacional que paradójicamente otorga parte de sus ingresos a la propia Corte IDH y quien pretendía sacarlo de tajo en su aspiración presidencial”
Así mismo, la Representante a la Cámara manifestó su complacencia por el fallo, ya que “no solamente es un triunfo de Petro, sino también de sus electores y sobre todo una ratificación de quienes llegan a estos cargos por elección popular, calidad que no puede desconocer una instancia administrativa como la que ejerció en su momento la Procuraduría General de la Nación en cabeza de Alejandro Ordoñez”
En ese sentido la Corte IDH concluyó que, la separación de su cargo en virtud de la decisión de la Procuraduría General de la Nación, constituyó una afectación de los derechos políticos de sus electores y del principio democrático.
Igualmente, la Corte IDH declaró que el proceso disciplinario seguido contra el Senador, no respetó la garantía de la imparcialidad ni el principio de presunción de inocencia, ya que la Sala Disciplinaria de la Procuraduría emitió no sólo su pliego de cargos, sino también la que profirió su fallo sancionatorio, concentrando así las facultades investigativas, acusatorias y sancionatorias.
En razón de estas violaciones, la Corte IDH ordenó, publicar la sentencia en su integridad en el sitio web de la Procuraduría General de la Nación, armonizar el ordenamiento jurídico interno con la Convención Americana de Derechos Humanos, de tal manera que los funcionarios de elección popular no puedan ser destituidos, ni inhabilitados por decisiones de autoridades administrativas, la publicación en el Diario Oficial del resumen de la sentencia y el reintegro de gastos y costas .
