Ángela Robledo propone incluir en Plan de Desarrollo recursos para jóvenes en conflicto con la ley
Bogotá, abril 28 de 2015
La representante a la Cámara y Co presidenta de la Comisión de Paz, Ángela Robledo, dijo que de aprobarse un artículo de su autoría en el Plan de Desarrollo dirigido a la financiación del Sistema de Responsabilidad Penal para Adolescentes, se cumpliría por primera vez la meta de contar con recursos específicos para la atención integral a jóvenes infractores de la ley.
“Revisamos con el Ministro de Justicia, Yesid Reyes y su equipo, la propuesta de financiación de programas de justicia, incluida la financiación del Sistema de Responsabilidad Penal para Adolescentes y la política de prevención de la delincuencia juvenil desde un enfoque de justicia restaurativa para garantizar los derechos de los adolescentes en conflicto con la ley”, aseguró la parlamentaria Angela Robledo.
La propuesta incluye la definición de “la Ley 55 de 1985 como fuente nacional permanente de la financiación del Sistema de Responsabilidad Penal para Adolescentes, para asegurar la prestación del servicio en todos los distritos judiciales del territorio nacional con plena garantía de derechos de los adolescentes y jóvenes en conflicto con la ley en todas la etapas de la ruta jurídica y durante el cumplimiento de su sanción”.
Robledo dijo que además de garantizar una atención integral para estos jóvenes en conflicto con la ley, necesitamos una justicia restaurativa y la implementación de penas pedagógicas que puedan brindar una segunda oportunidad a estos muchachos que han sido sistemáticamente excluidos y a quienes se les ha negado todos sus derechos.
Cifras oficiales demuestran que 33.98 de la población infantil, que en Colombia es de 32.69% de la población nacional, se encuentra en condiciones de pobreza multidimensional. Datos de Medicina Legal para 2013 muestran que 83% de las víctimas de violencia sexual son niñas y el 17% niños,
De acuerdo con el informe de gestión del ICBF de 2012, 69.684 niñas, niños y adolescentes fueron puestos en situación de protección por maltrato, violencia sexual, abuso sexual, abandono, consumo de sustancias sicoactivas y desnutrición, entre otras.
Unos 2.182.707 niños, niñas y adolescentes son víctimas del conflicto armado. La guerra impide que la mitad de los niños en el campo terminen sus estudios, sólo en el 2013 se registraron por lo menos 26 incidentes que causaron daños a las escuelas o la suspensión de las clases. El 80% de las seis mil víctimas de violencia sexual en el conflicto armado son niños. 7.722 han sido víctimas de reclutamiento forzado. 981 niños y niñas han sido víctimas de minas antipersonal de los cuales 218 perdieron la vida.
Los jóvenes en conflicto con la ley son la consecuencia directa de la exclusión y la pobreza, la ausencia de políticas contundentes de educación y la falta de oportunidades de una vida digna para las nuevas generaciones, puntualizó Ángela Robledo.
